In response to a proceeding filed by a textbook publisher, we have denied liability for allegations of copyright and trademark infringement by online sellers using the platform.
Pearson Education Inc. And a group of five educational publishers, including McGrawHill LLC. Sued Shopify in December.. Their proceedings allege that e-commerce companies are responsible for unauthorized school textbooks, test packs, and solution manuals sold by websites using Shopify’s services.
Shopify sells technology that enables people to launch websites, accept online payments, and ship and track orders to customers.
The e-commerce company said Friday that it was rejoining the proceedings and was compliant with existing copyright laws passed by Congress.
According to Shopify, publishers may not like the law, but courts are the wrong place to force changes to existing rules.
“This proceeding is an attempt through this court to do what plaintiffs could not achieve in the legislative field,” said Shopify’s response to the United States District Court for the Eastern District of Virginia.
The company also denied allegations that it wasn’t doing enough to stop the illegal sale of textbooks from websites that use Shopify’s online tools. “Shopify responded quickly to plaintiffs’ infringement notices, removed a large amount of allegedly infringing material, and repeatedly dismissed malicious persons,” the company said.
Shopify said it responded to over 5,000 deletion requests from textbook publishers, involving over 1,750 sellers and over 50,000 web addresses. Shopify said more than 90% of these web addresses have been removed.
Shopify is based in Canada, but the publisher is suing the company in Virginia because it has a server in Ashburn, Virginia.
