The Louisiana Administrative Law Department recently announced that insurance commissioner Jim Donelon has forced a deductible hurricane for certain losses caused by Hurricane Barry in July 2019 from State Farm Fire and Non-life Insurance Company ( He ruled that it was justified in his decision to thwart (State Farm).
Donelon issued a cease and desist order in August 2019 following policyholder complaints that State Farm’s hurricane deductions were improperly applied to claims. Commissioner’s actions have banned the execution of deductible hurricanes for losses incurred before 10:00 am on July 13, 2019.
The Administrative Law Department has determined that the Secretary’s order was reasonable and that the decision was made after an investigation by the Louisiana Department of Insurance (LDI) and extensive communication with State Farm.
“Protecting the rights of policyholders is at the core of our work and we are pleased that we were able to succeed on their behalf,” said Doneron. “Consumer grievance handling is an important factor in monitoring the insurance market after a natural disaster.
