Sacramento, California (AP) —California became the first state to ban “stealthing” or condom removal without permission during sexual intercourse.

Governor Gavin Newsom signed the law on Thursday. It adds this law to the state’s civil definition of sexual assault and makes it clear that victims can sue perpetrators, including punitive damages.

The law makes it illegal to remove a condom without verbal consent.

Democrat Christina Garcia tried to criminalize it in 2017 after findings found that stealthing was on the rise for both women and gay men.

Legislative analysts said it could already be considered a misdemeanor sexual assault, but was rarely prosecuted.
